1. About these terms

These Terms and Conditions are a legal agreement between you and BehindCandle (referred to below as "we", "us" or "our company"). They apply to our website behindcandle.com, the web charting platform, user accounts and all paid subscription plans. Together, these are called the "service".

Our Privacy policy, Refund and cancellation policy, Delivery policy and Risk disclaimer are also part of these Terms and Conditions.

By creating an account on BehindCandle, buying a subscription plan or using the service, you agree to these Terms and Conditions. If you do not agree, please do not use the service.

We may keep a record of the date and time of your acceptance.

2. What are the BehindCandle services?

BehindCandle is an online charting and market analysis platform. It is built to help traders understand activity in different financial markets, analyse charts and study the market data that is available. It is used through a web browser.

The main features of the platform may include:

• Charting: Multi-Chart and Multiple Timeframes.
• Market depth: Liquidity Map, DOM and Order Book Depth.
• Volume analysis: Candle Volume and related data.
• Technical analysis: EMA and other Technical Indicators.
• Market trend: Bullish and Bearish Analysis.
• Derivatives data: Open Interest (OI) and OI Buildup.
• Market information: Market News and Economic Calendar.
• Alerts: Alerts and Notifications.

The purpose of these features is to bring market information and analysis tools together on one platform, so that users need to switch between different platforms less often.

The availability of a particular feature or of market data may depend on the trading instrument, the data provider, technical limits and your active subscription plan.

3. No guarantee of any result or profit

BehindCandle is a market analysis and charting tool. It does not provide personal investment advice, financial advice or a recommendation to buy or sell any particular financial instrument.

The charts, indicators, bullish and bearish signals, liquidity data, volume, open interest and other analytical information on the platform are provided for informational and analytical purposes only.

BehindCandle does not guarantee any profit, accurate forecast or return on investment. Market conditions can change quickly, and the available data and indicators do not predict future results with certainty.

BehindCandle does not execute any trade on your behalf, does not hold your funds or digital assets, and does not manage them. It is not a broker, stock exchange, investment adviser or research analyst.

You are responsible for your trading and investment decisions and for any profit or loss that results from them, subject to the rights available to you under applicable law.

4. Who can use the service?

BehindCandle is made for people who want to analyse cryptocurrency, gold, silver, oil, gas, the energy sector and the other financial markets available on the platform.

BehindCandle is a global online service. It may be used in countries and regions where the use of such a service is permitted under applicable law.

To use the service you must be at least 18 years old and able to enter into a legally binding agreement under applicable law.

You are responsible for using the service in line with the laws, rules and restrictions that apply in your country or region. If the use of the service is restricted in your region, or if you are subject to any applicable legal restriction, you must not use the service.

Where applicable law allows it or requires it, we may restrict, suspend or end access to the service.

5. Your account

When you create a BehindCandle account, you must give correct, complete and up-to-date information. You are also responsible for keeping the email address on your account active and up to date.

Each account is for the personal use of one user only. One account may not be shared between several different people.

The same user may log in to their account from different browsers or devices, as long as the account is used by that same user and the use follows the subscription terms.

You are responsible for keeping your password, login codes and other security information confidential. Do not share them with anyone else.

If you suspect that someone else has used your account without permission, or that your login details have been compromised, tell us immediately at support@behindcandle.com.

We may take reasonable steps to keep accounts secure and to prevent unauthorised activity.

6. Plans and payments

To use the BehindCandle charting features and related paid services, you need an active and valid paid subscription plan. There is currently no free trial.

All available plans, their prices and their features are shown on our Pricing page.

Taxes: GST, VAT, sales tax or other taxes that apply in your country or region may be added to the payment amount where applicable. Information about applicable taxes is shown before you complete the payment.

Payment: Payments may be processed through a third-party payment gateway or an authorised payment provider. Your bank account, credit or debit card details and currency conversion are subject to the rules of the payment provider and the bank.

We do not store the full financial details of your card or bank account, except for limited information that may be kept where it is needed for a payment arrangement and permitted by law.

For payments in a foreign currency or international transactions, your bank, card issuer or payment provider may charge additional fees.

Account activation: After your payment is confirmed, your subscription is activated according to the plan you bought and remains available for that period.

Automatic renewal: If a plan has automatic renewal, this is shown at the time of purchase. If you do not turn renewal off before the set time, the plan may renew automatically at the price and on the terms in force at that time.

You can ask to turn off automatic renewal before the next renewal through the available account settings or by email to support@behindcandle.com. The cancellation deadline and payment terms depend on the plan.

Price changes do not apply to a subscription period that has already been paid for. New prices may apply to future purchases or renewals, provided the necessary information was made available beforehand.

7. Refund and cancellation policy

The subscription plans available on BehindCandle and their periods are shown on the Pricing page. At present the platform offers monthly plans, and there is no free trial.

Once a subscription has been bought and the payment completed, refunds are generally not given. Please check the price, period, features and terms of the plan carefully before you buy.

The rules for cancelling a subscription, turning off automatic renewal and related processes are set out in our Refund and cancellation policy.

Where a refund is required under applicable law, or where a user has a statutory right that cannot be removed by contract, this policy does not limit those rights.

8. Acceptable use policy

You may use BehindCandle only for lawful purposes and in line with these Terms and Conditions.

When using the service, you will not:

• use the platform for any unlawful activity or fraud;
• enter another person's account without permission or use their login details;
• try to damage or bypass the platform's security, or gain unauthorised access;
• carry out attacks that put unnecessary load on the website or servers, or use malicious code or other harmful activity;
• bypass the platform's technical limits, access controls or subscription restrictions in an unauthorised way;
• collect in bulk, resell or commercially distribute the platform's content, software or data without our written permission or the relevant licence;
• use the platform to violate the rights of another person or any applicable law.

You must not use the platform in a way that affects its security, its stability or other users' access.

If we reasonably suspect a violation, we may investigate the matter and take the necessary action in line with applicable law and these terms.

9. Intellectual property and rights of use

The intellectual property rights in the BehindCandle website, software, user interface, design, brand name, logo, original indicators and other original content belong to us or to our licensors.

During an active subscription you are given a limited, personal, non-exclusive and non-transferable right to use the platform. This right does not give you ownership of the platform or its content.

Except for activities permitted by applicable law, the relevant licence or our written permission, you may not copy, modify, redistribute, resell or make publicly available the platform's software or content without authorisation.

You will not try to bypass the platform's security, reverse engineer the software without authorisation or obtain its source code, except where applicable law allows it.

Third-party data, logos, trademarks and other licensed material remain subject to the rights of the relevant third parties.

If you send BehindCandle a suggestion, feedback or a feature idea, we may evaluate and use it, provided this is in line with applicable law, any separate agreement and your rights in your confidential information.

10. Market data and availability of the service

BehindCandle provides market data and charting features through its available data sources. Some data may be available live or in real time, while other data may be delayed or subject to the terms of the relevant data provider.

The accuracy, completeness, timeliness and availability of market data may depend on the relevant exchange, the data provider, your internet connection, technical systems and other external factors.

Prices from different exchanges or data sources may differ. Such differences can be caused by the timing of data updates, the trading instrument, liquidity or the process of the relevant data provider.

Our engineering and development team works to keep the platform running, to fix technical problems and to resolve issues with data and services. However, we do not guarantee that the service will always be available without interruption, error or delay.

The service may be affected by internet or network failures, data provider problems, interruptions at an exchange, cyber security incidents, war, natural disasters, government restrictions or other circumstances beyond our reasonable control.

To improve the stability, security and usefulness of the platform, we may carry out maintenance, technical improvements and necessary updates from time to time. During this time some features may be temporarily unavailable.

We may add new features to the platform, improve existing features, or change a feature for technical, legal or business reasons. Where necessary, action will be taken in line with applicable law and the relevant subscription terms.

11. Our content, indicators and custom services

The BehindCandle website, chart software, design, indicators and brand name are owned by us or by our licensors.

If you want to suggest a new indicator, a change to an existing indicator or any other feature, you can contact us by email. Our development team may consider your suggestion according to available resources, technical requirements and business priorities.

Accepting a suggestion, developing a new indicator or changing an existing feature depends on our review and availability. We do not guarantee that every request will be accepted or completed within a set time.

If you want a special feature, a custom indicator, larger software development or a separate platform built for your personal or business use, additional charges may apply. The cost, scope, timeline and other terms will be agreed before the work starts.

White label service: BehindCandle may offer a white label service to businesses that want to offer a platform of this kind under their own brand name. Contact us about its availability, features, licence, cost and other terms.

A separate written agreement may be made for custom development, white label service or business use. In such cases the terms of that agreement apply.

12. Limitation of liability

BehindCandle tries to keep the platform useful and reliable, but it does not give an unconditional guarantee of the availability of the service, the completeness or accuracy of the data, or its fitness for any particular purpose.

BehindCandle's liability for trading or investment losses resulting from decisions made on the basis of the data, charts, indicators, market signals or analysis on the platform is subject to applicable law and the valid limits of this agreement.

Where the law allows, BehindCandle will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, loss of expected profit or loss of data, where such loss falls within this limit under the applicable legal standards.

To the extent the law allows, we are not responsible for service interruptions caused by circumstances beyond our reasonable control, such as internet disruptions, failures of third-party data services or external technical problems.

Nothing in this section removes any liability or right that cannot be limited or removed under applicable law. This section does not take priority over any mandatory consumer right or liability set by law.

13. Suspension and termination

You can stop using the service at any time. If you want to close your account or need help with your subscription, use the available account settings or contact support@behindcandle.com.

Closing your account or stopping your use of the service does not by itself end the terms that relate to payments already made, refunds, cancellation or automatic renewal. The relevant payment and refund policy applies in these matters.

If we reasonably suspect that you have seriously violated these Terms and Conditions, committed fraud, put the security of the platform at risk or violated any applicable law, we may, in line with the law, temporarily suspend or end your account or your access to the service.

Where circumstances allow, we will try to inform you before or after the necessary action. However, immediate action may be needed for security, fraud prevention or legal compliance.

If the service is closed permanently or a subscription is ended, matters relating to payment, refunds and user rights will be settled in line with applicable law, the relevant policy and any applicable agreement.

After an account is ended, the provisions that by their nature should continue to apply will remain in force, such as intellectual property rights, valid limits of liability and payment obligations that have already arisen.

14. Changes to the terms, applicable law and contact

BehindCandle may change, amend or update these Terms and Conditions from time to time. The effective date of the latest version is shown at the top of this page.

If you continue to use the service after an update, the amended terms may apply, where applicable law allows it. If a change requires separate notice or the user's consent, we will act in line with the applicable legal requirements.

In providing its services, BehindCandle tries to follow the laws and rules that apply in the relevant countries and regions. Your use of the service is subject to the laws that apply where you are.

If you have a problem, complaint or suggestion about the service, your account, payment, data or any other matter, please contact us first. We will make every reasonable effort to review your complaint and find a suitable solution.

Depending on the nature of the complaint and the checks needed, a solution may take time. Please allow us up to 7 days to review and resolve a complaint. This is an estimated support period, unless a different time limit is set under applicable law.

If any provision of these terms is found invalid or unenforceable under applicable law, the remaining provisions will stay in force as far as possible.
